These Terms and Conditions apply when you buy goods or services from Coastal Sports Limited (“we”, “us”, “our”) through coastalsports.co.nz or in our Kaikōura store. Together with our Website Terms of Use, Privacy Policy, Shipping Info and Returns & Refunds pages, they form the agreement between you and us.

By placing an order you confirm you are at least 18 years old (or have a parent or guardian’s permission) and that you accept these terms.

2. New Zealand sales only

We sell and deliver to addresses in New Zealand only. Prices, shipping and these terms are for NZ customers. We do not offer international shipping.

3. Orders and acceptance

Listing a product on the website does not guarantee it is in stock. An order is an offer to buy. We accept the order when we confirm it by email or when we take payment and begin fulfilling it. We may decline or cancel an order if an item is out of stock, the price was listed incorrectly, or we reasonably suspect fraud. If we cancel after payment, we will refund you.

4. Prices and GST

All prices are in New Zealand dollars (NZD) and include GST unless we clearly say otherwise. Shipping is charged separately where it applies. We may change prices at any time; the price you pay is the price shown when you complete checkout (or the in-store price at the time of purchase).

5. Payment

We accept the payment methods shown at checkout and in store (for example card, bank transfer and PayPal where offered). Payment is due when you place the order unless we agree otherwise. We do not store full credit card details on our own systems; card payments are processed by our payment provider.

6. Delivery

Delivery times, couriers, rural addresses, bulky items, surfboards and bikes are set out on our Shipping Info page. Risk in the goods passes to you when they are delivered to the address you gave us (or collected in store). Title passes when we have received full payment.

You must provide a delivery address someone can receive parcels at. For surfboards and other freight that requires a signature, someone must be available to sign and note any damage on receipt.

7. Consumer Guarantees Act

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply. If you are buying goods or services for personal or household use, you have guarantees that goods are of acceptable quality, match their description, and are fit for the purpose you told us about (among others). Remedies may include repair, replacement or refund.

If you are buying for business use and the CGA allows contracting out, and we have agreed that with you in writing, different terms may apply.

8. Returns and refunds

Our returns, change-of-mind and faulty-goods process is set out on our Returns & Refunds page. That page forms part of these terms.

9. Product information

Product descriptions, specifications and images are provided in good faith from manufacturers and our own knowledge. Colours on screen may differ from the real product. If colour, size or fit is critical, contact us before you buy. We may correct obvious pricing or description errors.

10. Hire and workshop services

Surfboard, wetsuit and bike hire, and bike workshop services, are subject to the hire or workshop terms we give you at booking or drop-off (including any deposit, damage and late-return terms). Where those conflict with these general terms for the hire or repair itself, the hire or workshop terms apply.

11. Limitation of liability

To the extent permitted by law (and without limiting the Consumer Guarantees Act where it applies), we are not liable for loss of profit, loss of opportunity or other indirect loss arising from your purchase or use of our goods or services. Our total liability for any claim that is not covered by a mandatory consumer guarantee is limited to the price you paid for the relevant goods or services.

12. Privacy

We handle personal information under our Privacy Policy and the Privacy Act 2020.

13. Website use

Use of the website is also governed by our Website Terms of Use.

14. Changes

We may update these terms by posting a new version on this page. The version that applies to your order is the one in force when you place that order.

15. Governing law

These terms are governed by the laws of New Zealand. Any dispute is subject to the exclusive jurisdiction of the New Zealand courts.
